USCIS ISSUES NEW POLICY MEMORANDA ON REQUEST FOR EVIDENCE (RFE)

REQUEST FOR EVIDENCE (RFE) POLICY MEMORANDUM/MAKES IT EASIER FOR USCIS TO DENY CASES:

Effective September 11, 2018, USCIS grants adjudicators greater discretion to deny a case, without first issuing a Request for Evidence (RFE) if they deem a required initial piece of evidence to be missing:

  • Previously, USCIS officers were not allowed to deny an application/petition without first giving the petitioner or applicant an opportunity to provide more evidence to prove the case.
  • What it means: Ability to deny without an RFE.

WHAT CAN YOU DO:

Considering this recent Memoranda, it is increasingly necessary to present carefully and accurately prepared filings to USCIS. You should:

  • Take all possible precautions to ensure you include accurate and complete information as part of initial petition filing.
  • Pay close attention to expiration dates of your immigration status.
  • Consult with ISSS to address any questions or concerns you should have.
